Terms & Conditions

The Terms & Conditions are an integrated part of the contract between the participant and ebike Panorama Tours. Bookings can only be made in writing (by post or by e-mail). For minors (under the age of 18) we will need the signature of the parent or legal guardian. When booking, the participant accepts these Terms & Conditions. The mutual rights and responsibilities of the parties in the contract are exclusively regulated by these Terms & Conditions, subject to aberrant written agreements. With the acceptance of ebike Panorama Tours, the participant receives a written confirmation of the booking. All details of the booking are bound by these Terms & Conditions.

After receipt of our booking confirmation / invoice a deposit of 300,- Euro per participant is to be paid within 14 days. 14 days before the trail starts the remainder of the cost of the trail is to be paid. If the booking is made within 14 days before the trail starts or with amounts less than 300,- Euro, the payment amount in full is due with receipt of the booking confirmation. When booking a shared room, if there is no one to share the room with (due to cancellation or the absence of a room-sharer) the participant will be charged a single supplement.

Based on the description on our website (www.ebike-panoramatours.com) the range of services we provide are only available upon written confirmation from ebike Panorama Tours. Additional arrangements can only be made in writing.

The minimum length of time for renting an e-bike is two days. At least two e-bikes must be rented (in certain cases exceptions can be made, if agreed in advance in writing).

ebike Panorama Tours will provide the client with clean and well-maintained e-bikes and accessories. During the rental period, the client is responsible for the e-bikes and accessories provided by ebike Panorama Tours. We appreciate it if you return the e-bikes and accessories free from major dirt. If e-bikes and / or accessories cannot be returned in an appropriate condition, this might lead to additional charges.

We recommend that you check and test the bike when you receive it. Kindly inform us immediately about any possible faults. ebike Panorama Tours is not liable for any damages to the bike (including flat tyres) during the rental period. Damages other than regular traces of usage as well as theft, regardless of the party at fault, lead to additional charges.

If you book an e-bike delivery of your rented bike by ebike Panorama Tours, the following conditions apply:

For delivery within the area marked on this map, we charge 40,- Euro both ways (return journey for 1 to 4 e-bikes). Delivery to a location that is further away can be individually requested. In this case, the delivery cost will be defined in writing by ebike Panorama Tours. e-bikes can also be picked up in Girona, according to the following timetable: Monday to Friday 9:00 to 13:00 and 16:00 to 20:00, Saturday 10:00 to 13:30.

The client needs to receive the e-bikes personally at the agreed location.

Withdrawal from the contract is possible at any time before the commencement of the rental. All cancellations must be made in writing. When cancelling the following sums of the total amount are to be paid by the client:

• Up to 70 days before rental start - 25% of the price
• From 15 to 69 days before the rental start - 50% of the price
• Within 14 days before the rental start - 85% of the price

If the client does not appear on the day of the rental start or cancels on the day of the rental start, then the amount due is 100% of the rental price.

If the client is not in a condition to safely ride a bicycle (e.g. under the influence of alcohol), ebike Panorama Tours reserves the right to refuse the delivery of the rented e-bikes. In this case, the total price for the e-bike rental will not be refunded.

ebike Panorama Tours reserves the right to cancel the confirmed e-bike rental for any reason. In this case, the full amount that has been paid by the client will be refunded. However, ebike Panorama Tours cannot be held liable for any further compensation.

ebike Panorama Tours agrees, within reasonable limits, to provide the agreed services, accurate tour descriptions, the careful selection and scrutiny of service providers and the complete delivery of the overall services.

It is pointed out explicitly that cycling is a high risk activity. The participation in all activities is at the rider’s own risk. ebike Panorama Tours and its tour guides do not accept liability for any accident or injury to any persons or for any damage to pieces of riding / sports equipment. The participant is responsible for insuring themselves against all occurring risks. We strongly recommend baggage insurance (e.g. against damage or loss) plus accident, illness, recovery, repatriation and liability insurance. The wearing of a safety helmet is mandatory for all our tours. ebike Panorama Tours reserves the right to exclude participants who disregard the wearing of a safety helmet. With regards to the impact of weather conditions and the personal ability of the participant, ebike Panorama Tours cannot guarantee that any tour will be carried out exactly as it is described in the programme. At the time of planning, the routes of the tours were based on the current road traffic regulations. ebike Panorama Tours cannot be held liable for any later changes to these regulations.

ebike Panorama Tours’s liability for the loss or damage to baggage will be limited to twice the total cost of the holiday. With regards to the services of third-parties (e.g. hotels), ebike Panorama Tours only acts as a broker and does not accept liability for the quality and supply of their services. ebike Panorama Tours do not accept responsibility for the cancellation of any tour due to adverse weather conditions and will not offer compensation under these circumstances. If included in the trail description, ebike Panorama Tours offers a baggage transfer and, in exceptional cases, passenger transport in an escort vehicle (max. 2 people). Special transfers due to any person being unable to ride with the group are at the expense of the participant. If the number of participants is not achieved, ebike Panorama Tours reserves the right to combine any tours without prior notice.

The traveller is responsible for their own arrival and departure and the compliance with regulations concerning passports and visas, as well as any mandatory vaccinations. All expenditures and disadvantages due to non-compliance are at the expense of the traveller. When registering, the participant confirms that there are no existing health issues which prohibit their participation in ebike Panorama Tours activities.

Complaints should be reported immediately on site, so that the responsible person can deal with the matter as soon as possible. Claims for compensation are to be sent in writing within 30 days of the end of the holiday.

ebike Panorama Tours reserves the right to make changes to the programme and prices and to correct any falsities and misprints. The participant commits to respectful behaviour towards the group and to accept reasonable decisions made by ebike Panorama Tours’s staff. A great deal of time and cost is spent on planning the routes for the tours. The routes are an essential part of our offer and ebike Panorama Tours therefore prohibits the recording of these routes.

On the tours that include going to the beach for a swim, it is forbidden to go onto sand beaches on the bikes. Any damage to the bike for this reason will be at your own cost. We will provide you with locks to tie-up and secure the bikes before descending onto the beaches.

During our tours, photos are taken, and film recordings are made which may be published on different media sites, including social media. These recordings are a representation of the persons present and the selection of persons recorded or photographed is made at random. The images may be displayed on our homepage, in printed media or on social media channels. The participant accepts that the unpaid publication of these photographs and recordings is done without their permission. If the concerned person does not agree to the publication of his or her personal image, we kindly ask you to notify us by e-mail, telephone or by post with the exact description of the picture in question. In this instance, the image will be removed within a reasonable time-frame and will no longer be published.
